Insolvenzordnung (InsO)<\/strong><\/p>\n

\u00a7 168 Mitteilung der Ver\u00e4u\u00dferungsabsicht<\/p>\n

(1) Bevor der Insolvenzverwalter einen Gegenstand, zu dessen Verwertung er nach \u00a7 166 berechtigt ist, an einen Dritten ver\u00e4u\u00dfert, hat er dem absonderungsberechtigten Gl\u00e4ubiger mitzuteilen, auf welche Weise der Gegenstand ver\u00e4u\u00dfert werden soll. Er hat dem Gl\u00e4ubiger Gelegenheit zu geben, binnen einer Woche auf eine andere, f\u00fcr den Gl\u00e4ubiger g\u00fcnstigere M\u00f6glichkeit der Verwertung des Gegenstands hinzuweisen.<\/p>\n

(2) Erfolgt ein solcher Hinweis innerhalb der Wochenfrist oder rechtzeitig vor der Ver\u00e4u\u00dferung, so hat der Verwalter die vom Gl\u00e4ubiger genannte Verwertungsm\u00f6glichkeit wahrzunehmen oder den Gl\u00e4ubiger so zu stellen, wie wenn er sie wahrgenommen h\u00e4tte.<\/p>\n

(3) Die andere Verwertungsm\u00f6glichkeit kann auch darin bestehen, dass der Gl\u00e4ubiger den Gegenstand selbst \u00fcbernimmt. G\u00fcnstiger ist eine Verwertungsm\u00f6glichkeit auch dann, wenn Kosten eingespart werden.<\/p>\n
